1. Service Description
Nudge (Nudge Technologies Ltd., Istanbul, Turkey) is a SaaS platform providing competitor price monitoring, MAP violation detection, and AI-powered pricing recommendations. By using the platform, you agree to these terms.
2. Account and Access
An account is required to use the platform. The user is responsible for account security. Sharing a single account among multiple people is not permitted; a team plan must be selected.
3. Subscription and Payment
- The platform is in early access; there is no self-serve signup and no automatic billing
- Plan limits (product count, number of monitored sites) are defined and enforced
- Fees are governed by terms agreed separately in writing between the parties
- No card details are stored and no auto-renewing subscription cycle is operated
- Use under early access may be terminated by either party at any time
4. Acceptable Use
The platform may only be used for legitimate business purposes. The following are prohibited:
- Automated or abusive use of the platform
- Using another person's credentials
- Actions that compromise platform security
- Any use that violates applicable law
5. Intellectual Property
All rights to the platform belong to Nudge. Users retain ownership of content they upload. Nudge is granted a licence to use that content solely for service delivery.
6. Data Ownership and Deletion
Product data you upload remains yours. Upon account closure, all your data is permanently deleted within 30 days.
7. Service Level
A monthly uptime target of 99.5% is committed for Growth and Enterprise plans. Scheduled maintenance is announced at least 48 hours in advance. Proportional credits are applied when the committed level is not met.
8. Limitation of Liability
Nudge does not guarantee pricing recommendations; they are for informational purposes only. Nudge's liability is limited to the amount of the last 3 months of subscription fees in any case.
9. Changes to Terms
Nudge may change these terms with prior notice. Material changes are communicated by email at least 30 days in advance.
10. Governing Law
These terms are governed by Turkish law. The courts of Istanbul have jurisdiction over any disputes.
